Privacy Policy & Principles

The ComicCapital Privacy Policy describes how ComicCapital and its subsidiaries treat personal information when you use ComicCapital services, including information provided when you use ComicCapital. In addition, the following describes privacy practices specific to ComicCapital. To understand how we treat the information you give us as you use ComicCapital, you should read this policy and the ComicCapital Privacy Policy.
We built ComicCapital to make it easy to share information with your friends and people around you. We understand you may not want everyone in the world to have the information you share on ComicCapital; that is why we give you control of your information. Our default privacy settings limit the information displayed in your profile to your networks and other reasonable community limitations that we tell you about. ComicCapital is committed to your right to privacy and to keeping your personal information private. Because our web site includes areas in which individuals can provide personally identifiying information, we have developed the ComicCapital Privacy Policy below to inform you of our policies and practices regarding information we collect about you on this site. This Privacy Policy governs the URL http://www.comiccapital.com. The information about you described in this document is controlled by ComicCapital professionals.
Sharing information should be easy. And we want to provide you with the privacy tools necessary to control how and with whom you share that information. If you have questions or ideas, please send them to privacy@ComicCapital.com
I. Personal Information
Non-Account Activity. You can watch videos on ComicCapital without having a ComicCapital Account or a ComicCapital Account. You can also contact us about a particular video without having a ComicCapital Account or a ComicCapital Account.
Account-Related Activity. Certain other activities on ComicCapital require you to have a ComicCapital Account. We ask for some personal information when you create a ComicCapital Account, including your email address and a password, which is used to protect your account from unauthorized access. A ComicCapital Account allows you to access many of our services that require registration.
Usage Information. We may record information about your usage, such as when you use ComicCapital, the channels, groups, and favorites you subscribe to, the contacts you communicate with, the videos you watch, and the frequency and size of data transfers, as well as information you display or click on in ComicCapital (including UI elements, settings, and other information). If you are logged in, we may associate that information with your account. We may use clear GIFs (a.k.a. "Web Beacons") in HTML-based emails sent to our users to track which emails are opened by recipients.
Content Uploaded to Site. Any personal information or video content that you voluntarily disclose online (on discussion boards, in messages and chat areas, within your playback or profile pages, etc.) becomes publicly available and can be collected and used by others.
II. Safe Use of ComicCapital
If you submit personally identifiable information to us through the ComicCapital Site, we use your personal information to operate, maintain, and provide to you the general and personalized features and functionality of the ComicCapital Site, and to process any flagging activity or correspondence you send to us.
Your account name (not your email address) is displayed to other Users when you upload videos or send messages through the ComicCapital Site and other Users can contact you through messages and comments. Any videos that you submit to the ComicCapital Site may be redistributed through the internet and other media channels, and may be viewed by the general public. If you have enabled Active Sharing, other users may see that you, as identified by your account name (not your email address), are watching the same video.
We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major ComicCapital Site changes or for customer service purposes).
We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous user usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the ComicCapital Site and to create new features, promotions, functionality, and services by storing, tracking, analyzing, and processing user preferences and trends, as well as user activity and communications.
We use cookies, clear gifs, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you visit the ComicCapital Sites; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests. If you download the ComicCapital Uploader, your copy of the of the Uploader includes a unique application number. The unique application number and information about your installation of the Uploader (e.g. version number, language) will be sent to ComicCapital when the Uploader automatically checks for updates.
III. ComicCapital's Privacy Policy
ComicCapital's Privacy Policy is designed to help you understand how we collect and use the personal information you decide to share, and help you make informed decisions when using ComicCapital, located at www.ComicCapital.com and its directly associated domains (collectively, "ComicCapital" or "Website")
By using or accessing ComicCapital, you are accepting the practices described in this Privacy Policy.
ComicCapital is a licensee of the TRUSTe Privacy Program. TRUSTe is an independent, non-profit organization whose mission is to build user's trust and confidence in the Internet by promoting the use of fair information practices. This privacy statement covers the site www.ComicCapital.com and its directly associated domains. Because this Web site wants to demonstrate its commitment to your privacy, it has agreed to disclose its information practices and have its privacy practices reviewed for compliance by TRUSTe.
If you have questions or concerns regarding this statement, you should first contact our privacy staff at privacy@ComicCapital.com. If you do not receive acknowledgement of your inquiry or your inquiry has not been satisfactorily addressed, you should contact TRUSTe Watchdog at http://www.truste.org/consumers/watchdog_complaint.php. IV. EU Safe Harbor Participation
We participate in the EU Safe Harbor Privacy Framework as set forth by the United States Department of Commerce. As part of our participation in the safe harbor, we have agreed to TRUSTe dispute resolution for disputes relating to our compliance with the Safe Harbor Privacy Framework. If you have any complaints regarding our compliance with the Safe Harbor you should first contact us at info@ComicCapital.com . If contacting us does not resolve your complaint, you may raise your complaint with TRUSTe at http://www.truste.org/users/users_watchdog_intro.html.
V. The Information We Collect
When you visit ComicCapital you provide us with two types of information: personal information you knowingly choose to disclose that is collected by us and Web Site use information collected by us as you interact with our Web Site.
When you register with ComicCapital, you provide us with certain personal information, such as your name, your email address, your telephone number, your address, your gender, and any other personal or preference information that you provide to us.
When you enter ComicCapital, we collect your browser type and IP address. This information is gathered for all ComicCapital visitors. In addition, we store certain information from your browser using "cookies." A cookie is a piece of data stored on the user's computer tied to information about the user. We use session ID cookies to confirm that users are logged in. These cookies terminate once the user closes the browser. By default, we use a persistent cookie that stores your login ID (but not your password) to make it easier for you to login when you come back to ComicCapital. You can remove or block this cookie using the settings in your browser if you want to disable this convenience feature.
When you use ComicCapital, you may set up your personal profile, form relationships, send messages, perform searches and queries, form groups, set up events, add applications, and transmit information through various channels. We collect this information so that we can provide you the service and offer personalized features. In most cases, we retain it so that, for instance, you can return to view prior messages you have sent or easily see your friend list. When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of that information.
You post User Content (as defined in the ComicCapital Terms of Use) on the Site at your own risk. Although we allow you to set privacy options that limit access to your pages, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that User Content you post on the Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. You understand and acknowledge that, even after removal, copies of User Content may remain viewable in cached and archived pages or if other Users have copied or stored your User Content.
Any improper collection or misuse of information provided on ComicCapital is a violation of the ComicCapital Terms of Service and should be reported to privacy@ComicCapital.com
If you choose to use our invitation service to tell a friend about our site, we will ask you for information needed to send the invitation, such as your friend's email address. We will automatically send your friend a one-time email inviting him or her to visit the site. ComicCapital stores this information to send this one-time invitation, to register a friend connection if your invitation is accepted, and to track the success of our referral program. Your friend may contact us at info@ComicCapital.com to request that we remove this information from our database.
ComicCapital may also collect information about you from other sources, such as newspapers, blogs, instant messaging services, and other users of the ComicCapital service through the operation of the service in order to provide you with more useful information and a more personalized experience.
You can browse our sites without telling us who you are or revealing any personal information about yourself. Once you give us your personal information, you are not anonymous to us. If you choose to provide us with personal information, you consent to the transfer and storage of that information on our servers located in the United States.
We may collect and store the following personal information: email address, physical contact information, and (depending on the service used) sometimes financial information, such as credit card or bank account numbers; transactional information based on your activities on the sites (such as bidding, buying, selling, item and content you generate or that relates to your account); shipping, billing and other information you provide to purchase or ship an item; community discussions, chats, dispute resolution, correspondence through our sites, and correspondence sent to us; other information from your interaction with our sites, services, content and advertising, including computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information; additional information we ask you to submit to authenticate yourself or if we believe you are violating site policies (for example, we may ask you to send us an ID or bill to verify your address, or to answer additional questions online to help verify your identity or ownership of an item you list); information from other companies, such as demographic and navigation data; and other supplemental information from third parties (for example, if you incur a debt to ComicCapital, we will generally conduct a credit check by obtaining additional information about you from a credit bureau, as permitted by law). By using ComicCapital, you are consenting to have your personal data transferred to and processed in the United States.
We don't sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. If you don't wish to receive marketing communications from us or participate in our ad-customization programs, simply indicate your preference in My ComicCapital or by following the directions provided with the communication or advertisement.
Your information is stored on our servers located in the United States. We treat data as an asset that must be protected and use lots of tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications would always remain private.
When you create an account on the site, some information about your account and your account activity will be provided to other Users of the site. Your account name (not your email address) is displayed to other Users when you engage in certain activity on the site. Other Users can contact you through messages and comments. You may also choose to add personal information that will visible to other Users on your page. This may include a profile picture, you name, gender, relationship status, or other details. If you choose to add certain features to your page, then these features and your activity associated with these features will be displayed to other Users and may be aggregated and shared with your confirmed friends or other Users. Any videos that you submit to the ComicCapital Sites may be redistributed through the internet and other media channels, and may be viewed by the general public. You may, of course, decline to submit personally identifiable information through the ComicCapital Sites, in which case you can still view videos and explore the ComicCapital Sites, but ComicCapital may not be able to provide certain services to you. Some advanced ComicCapital features may, for authentication purposes, require you to sign up for other ComicCapital services. The privacy notices of those services govern the use of your personal information associated with them. You may update or correct your personal profile information and email preferences at any time by visiting your account profile page. You may clear your viewing history at any time through the "Viewing History" feature. You may control the information that is available to other Users and your confirmed friends at any time by editing your account and the features that are included on your page.
VI. Children Under Age 13
ComicCapital does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for ComicCapital or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on ComicCapital. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at info@ComicCapital.com
VII. Children Between the Ages of 13 and 18
We recommend that minors over the age of 13 ask their parents for permission before sending any information about themselves to anyone over the Internet.
VIII. Use of Information Obtained by ComicCapital
When you register with ComicCapital, you create your own profile and privacy settings. Your profile information, as well as your name, email and photo, are displayed to people in the networks specified in your privacy settings to enable you to connect with people on ComicCapital. We may occasionally use your name and email address to send you notifications regarding new services offered by ComicCapital that we think you may find valuable. Profile information is used by ComicCapital primarily to be presented back to and edited by you when you access the service and to be presented to others permitted to view that information by your privacy settings. In some cases where your privacy settings permit it, other ComicCapital users may be able to supplement your profile. Profile information you submit to ComicCapital will be available to users of ComicCapital who belong to at least one of the networks you allow to access the information through your privacy settings. Your name, network names, and profile picture thumbnail will be available in search results across the ComicCapital network and those limited pieces of information may be made available to third party search engines. This is primarily so your friends can find you and send a friend request. People who see your name in searches, however, will not be able to access your profile information unless they have a relationship to you (friend, friend of friend, member of your networks, etc.) that allows such access based on your privacy settings. ComicCapital may send you service-related announcements from time to time through the general operation of the service.
Generally, you may opt out of such emails from the Notifications page, though ComicCapital reserves the right to send you notices about your account even if you opt out of all voluntary email notifications. ComicCapital may use information in your profile without identifying you as an individual to third parties. We do this for purposes such as aggregating how many people in a network like a band or movie and personalizing advertisements and promotions so that we can provide you ComicCapital. We believe this benefits you. You can know more about the world around you and, where there are advertisements, they're more likely to be interesting to you. We may use information about you that we collect from other sources, including but not limited to newspapers and Internet sources such as blogs, instant messaging services, ComicCapital Platform developers and other users of ComicCapital, to supplement your profile. Where such information is used, we generally allow you to specify in your privacy settings that you do not want this to be done or to take other actions that limit the connection of this information to your profile.
Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience. You agree that we may use your personal information to:
- provide the services and customer support you request;
- resolve disputes, collect fees, and troubleshoot problems;
- prevent potentially prohibited or illegal activities, and enforce our User Agreement;
- customize, measure and improve our services, content and advertising;
- tell you about our services and those of our corporate family, targeted marketing, service updates, and promotional offers based on your communication preferences; and
- compare information for accuracy, and verify it with third parties.
IX. Sharing Your Information with Third Parties
ComicCapital is about sharing information with others friends and people in your networks while providing you with privacy settings that restrict other users from accessing your information. We allow you to choose the information you provide to friends and networks through ComicCapital. Our network architecture and your privacy settings allow you to make informed choices about who has access to your information. We do not provide contact information to third party marketers without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is 1) reasonably necessary to offer the service, 2) legally required or, 3) permitted by you.
We may provide information to service providers to help us bring you the services we offer. Specifically, we may use third parties to facilitate our business, such as to host the service at a co-location facility for servers, to send out email updates about ComicCapital, to remove repetitive information from our user lists, to process payments for products or services, to offer an online job application process, or to provide search results or links (including sponsored links). In connection with these offerings and business operations, our service providers may have access to your personal information for use for a limited time in connection with these business activities. Where we utilize third parties for the processing of any personal information, we implement reasonable contractual and technical protections limiting the use of that information to the ComicCapital-specified purposes.
If you, your friends, or members of your network use any third-party applications developed using the ComicCapital Platform ("Platform Applications"), those Platform Applications may access and share certain information about you with others in accordance with your privacy settings. You may opt-out of any sharing of certain or all information through Platform Applications on the Privacy Settings page. In addition, third party developers who have created and operate Platform Applications ("Platform Developers"), may also have access to your personal information (excluding your contact information) if you permit Platform Applications to access your data. Before allowing any Platform Developer to make any Platform Application available to you, ComicCapital requires the Platform Developer to enter into an agreement which, among other things, requires them to respect your privacy settings and strictly limits their collection, use, and storage of your information. However, while we have undertaken contractual and technical steps to restrict possible misuse of such information by such Platform Developers, we of course cannot and do not guarantee that all Platform Developers will abide by such agreements. Please note that ComicCapital does not screen or approve Platform Developers and cannot control how such Platform Developers use any personal information that they may obtain in connection with Platform Applications. In addition, Platform Developers may require you to sign up to their own terms of service, privacy policies or other policies, which may give them additional rights or impose additional obligations on you, so please make sure to review these terms and policies carefully before using any Platform Application. You can report any suspected misuse of information through the ComicCapital Platform and we will investigate any such claim and take appropriate action against the Platform Developer up to and including terminating their participation in the ComicCapital Platform and/or other formal legal action.
We occasionally provide demonstration accounts that allow non-users a glimpse into the ComicCapital world. Such accounts have only limited capabilities (e.g., messaging is disabled) and passwords are changed regularly to limit possible misuse. We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share account or other information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the ComicCapital service or using the ComicCapital name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies. We let you choose to share information with marketers or electronic commerce providers through sponsored groups or other on-site offers. We may offer stores or provide services jointly with other companies on ComicCapital. You can tell when another company is involved in any store or service provided on ComicCapital, and we may share customer information with that company in connection with your use of that store or service.
Like many other websites that interact with third party sites, we may receive some information even if you are logged out from ComicCapital, or that pertains to non-ComicCapital users, from those sites in conjunction with the technical operation of the system. In cases where ComicCapital receives information on users that are not logged in, or on non-ComicCapital users, we do not attempt to associate it with individual ComicCapital accounts and will discard it. If the ownership of all or substantially all of the ComicCapital business, or individual business units owned by ComicCapital, Inc., were to change, your user information may be transferred to the new owner so the service can continue operations. In any such transfer of information, your user information would remain subject to the promises made in any pre-existing Privacy Policy. When you use ComicCapital, certain information you post or share with third parties (e.g., a friend or someone in your network), such as personal information, comments, messages, photos, videos, Marketplace listings or other information, may be shared with other users in accordance with the privacy settings you select. All such sharing of information is done at your own risk. Please keep in mind that if you disclose personal information in your profile or when posting comments, messages, photos, videos, Marketplace listings or other items, this information may become publicly available.
Your User ID is displayed throughout ComicCapital (and so available to the public), and is connected to all of your ComicCapital activity. Notices sent to other community members about suspicious activity and policy violations on our sites refer to User IDs and specific items. So if you associate your name with your User ID, the people to whom you have revealed your name will be able to personally identify your ComicCapital activities.
If you access our sites from a shared computer or a computer in an internet café, certain information about you, such as your User ID, activity or reminders from ComicCapital, may also be visible to other individuals who use the computer after you. ComicCapital enables you to share personal and financial information to complete transactions. We encourage you to disclose your privacy practices and respect the privacy of other users. We cannot guarantee the privacy or security of your information and therefore we encourage you to evaluate the privacy and security policies of your trading partner before entering into a transaction and choosing to share your information. To help protect your privacy, we allow only limited access to other users' contact, shipping and financial information to facilitate your transactions. When users are involved in a transaction, they may have access to each other's name, User ID, email address and other contact and shipping information. In all cases, you must give other users a chance to remove themselves from your database and a chance to review what information you have collected about them.
You agree to use user information only for:
ComicCapital transaction-related purposes that are not unsolicited commercial messages; using services offered through ComicCapital (e.g. escrow, insurance, shipping and fraud complaints), or other purposes that a user expressly chooses.
Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether they are bidders, buyers or sellers on our sites or other sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. ComicCapital does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. We encourage you to ask questions before you disclose your personal information to others.
X. Our Disclosure of Your Information
We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect anyone's rights, property, or safety. Such information will be disclosed in accordance with applicable laws and regulations.
We may also share your personal information with:
- members of the ComicCapital LLC corporate family to provide joint content and services (like registration, transactions and customer support), to help detect and prevent potentially illegal acts and violations of our policies, and to guide decisions about their products, services and communications. Members of our corporate family will use this information to send you marketing communications only if you’ve requested their services.
- service providers under contract who help with our business operations (such as fraud investigations, bill collection, affiliate and rewards programs and co-branded credit cards).
- other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).
- law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity. In such events, we will disclose information relevant to the investigation, such as name, city, state, zip code, telephone number, email address, User ID history, IP address, fraud complaints, and bidding and listing history.
- ComicCapital VeRO Program participants under confidentiality agreement, as we in our sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, we will disclose name, street address, city, state, zip code, country, phone number, email address and company name.
- Other business entities, should we plan to merge with or be acquired by that business entity. (Should such a combination occur, we will require that the new combined entity follow this privacy policy with respect to your personal information. If your personal information will be used contrary to this policy, you will receive prior notice.)
- Without limiting the above, in an effort to respect your privacy and our ability to keep the community free from bad actors, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

ComicCapital may contain links to other websites. We are of course not responsible for the privacy practices of other web sites. We encourage our users to be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by ComicCapital.
XII. Third Party Advertising
Advertisements that appear on ComicCapital are sometimes delivered (or "served") directly to users by third party advertisers. They automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and "web beacons" (also known as "1x1 gifs") to measure the effectiveness of their ads and to personalize advertising content. Doing this allows the advertising network to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. ComicCapital does not have access to or control of the cookies that may be placed by the third party advertisers. Third party advertisers have no access to your contact information stored on ComicCaptial unless you choose to share it with them. This privacy policy covers the use of cookies by ComicCapital and does not cover the use of cookies or other tracking technologies by any of its advertisers. ComicCapital does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. However, please note that if an advertiser asks ComicCapital to show an advertisement to a certain audience (for example, men ages 18-34) or audience segment (for example, men ages 18-24 who have viewed certain channels of content) and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach. The advertiser may also use information regarding your use of the ComicCapital Sites, such as the number of times you viewed an ad (but not any personally identifiable information), to determine which ads to deliver to you.
You should consult the respective privacy policies of these third-party ad servers or ad networks for more information on their practices and for instructions on how to opt-out of certain practices. ComicCapital's privacy policy does not apply to, and we cannot control the activities of, such other advertisers or web sites. Any data obtained by third-party ad servers subsequently shared with ComicCapital is maintained and dealt with by ComicCapital in accordance with this privacy policy.
XIII. Changing or Removing Information
Access and control over most personal information on ComicCapital is readily available through the profile editing tools. ComicCapital users may modify or delete any of their profile information at any time by logging into their account. Information will be updated immediately. Individuals who wish to deactivate their ComicCapital account may do so on the My Account page. Removed information may persist in backup copies for a reasonable period of time but will not be generally available to members of ComicCapital.
Where you make use of the communication features of the service to share information with other individuals on ComicCapital, however, (e.g., sending a personal message to another ComicCapital user) you generally cannot remove such communications.
XIV. Security
ComicCapital takes appropriate precautions to protect our users' information. Your account information is located on a secured server behind a firewall. When you enter sensitive information (such as credit card number or your password), we encrypt that information using secure socket layer technology (SSL). (To learn more about SSL, go to http://en.wikipedia.org/wiki/Secure_Sockets_Layer). Because email and instant messaging are not recognized as secure communications, we request that you not send private information to us by email or instant messaging services.
